Terms of Service

About these terms

These terms are between you and Marketable, an AI-first platform based in New Zealand that plans, launches and manages advertising campaigns for small businesses. By using this website, joining the waitlist or using the Marketable service, you agree to these terms. We may add specific terms for paid plans.

The waitlist

Joining the waitlist is free. It does not guarantee you access to Marketable or promise a launch date. You must own the email address you submit, and you can leave the waitlist at any time by emailing us.

The service

Marketable provides an AI agent that plans, launches and manages advertising campaigns in the advertising accounts you connect, starting with Google Ads. It works towards the goals and within the budgets you set. By connecting an account, you authorise Marketable to make changes in that account on your behalf. Advertising spend is charged to you directly by the advertising platform under your agreement with them.

Your responsibilities

  • Give us accurate information and keep it up to date.
  • Only connect advertising accounts you own or are authorised to manage.
  • Make sure your business, your ads and the pages they link to comply with the law and with each advertising platform's policies, such as the Google Ads policies.
  • Keep your login details secure and tell us if you think your account has been compromised.
  • Do not misuse the service — for example by attempting to access other people's accounts, interfering with the service, or reverse engineering it.

AI and results

Marketable makes changes in your connected accounts automatically, within the goals and budgets you set. It can make mistakes. You are responsible for setting budgets and limits you are comfortable with. We do not guarantee any particular results, such as a number of visits, leads or sales. You can pause the agent or disconnect an account at any time.

Fees

When paid plans are available, their prices and any trial terms will be shown clearly before you pay.

Intellectual property

The Marketable website, brand and software belong to us. Your content, your business information and your advertising data remain yours. You give us permission to use them only as needed to operate the service for you.

Third-party services

Marketable connects to services run by others, such as Google Ads. Those services have their own terms, which you agree to directly with them. We are not responsible for their availability, their decisions, or actions they take, such as suspending an account or rejecting an ad.

Availability and changes

Marketable is new software and will change over time. Features may be added, altered or removed, and the service may occasionally be unavailable.

Liability

If you use Marketable as a consumer, the New Zealand Consumer Guarantees Act 1993 applies. If you use Marketable for business purposes, you are acquiring it in trade; you agree that the Consumer Guarantees Act does not apply, and that this is fair and reasonable.

To the extent the law allows, Marketable is not liable for indirect or consequential loss, including lost profits or wasted advertising spend, and our total liability to you is limited to the fees you paid us in the three months before the event that caused the claim.

Ending the relationship

You can stop using Marketable, leave the waitlist or close your account at any time. We may suspend or close accounts that breach these terms. When an account is closed, we delete your information as described in our Privacy Policy.

Governing law

These terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction over any dispute.

Changes to these terms

When we change these terms we will update the date at the top of the page. If a change is significant, we will email you before it takes effect; if you do not accept it, you can close your account.
